Terms and Conditions for Get Gorgeous with Scunci Styling Tools

  1. Information on how to enter and prizes form part of these terms and conditions (“Conditions of Entry”). Any entry not complying with these Conditions of Entry will be deemed invalid and rejected. Submission of an entry is deemed acceptance of these Conditions of Entry.

  2. Entry is only open to residents of Australia and New Zealand, aged 18 years or older or if under 18yrs with the full permission of a parent or guardian. Employees of the Promoter, and their immediate families and agencies associated with are ineligible to enter.

  3. The Competition commences on 19/11/12. Prize pack entries close at 11.59pm AEST on 16/12/12.  (“Competition Period”).

  4. To enter, individuals must, during the Competition Period submit the fully completed Entry Form and/or follow the instructions on how to vote.

  5. Primary Prizes: 10 valid and randomly selected entries will win 1 of 10 major prizes consisting of a Scunci Styling Pack valued at $205.55.

  6. Prize pool is a Scunci Styling pack valued at $2,055.50 ($205.55 each) including 8 x Scunci Styling tools, VS Sassoon Bag, Rusk Deep shine pack, hair elastics, bobby pins, comb, brush set & mirror.

  7. Week 1 (2 x prize packs) runs 19/11/12 to 25/11/12, Week 2 (2 x prize packs) runs 26/12/12 to 02/12/12, Week 3 (2 x prize packs) runs 03/12/12 to 09/12/12, Week 4 (4 x prize packs) runs 10/12/12 to 16/12/12. Winners announced day after end of each phase.

  8. This competition is a game of skill. Chance plays no part in determining who is selected as the winner. All valid entries received during the Competition Period will be individually judged based on literary and creative merit and originality of the Work. Judging will take place at the Promoter’s premises. Winners will be notified by email or telephone using contact details provided in their entry. 

  9. Individuals who are selected as 'winners' names will be published online at under the ‘Competitions’ section on 17/12/12.

  10. Numerous entries per person are permitted but only 1 prize category per person is redeemable.

  11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  13. Incomplete, indecipherable or illegible entries will be deemed invalid.

  14. The selection of winner’s will take place at the Promoter’s premises.

  15. Prizes do not include any ancillary costs associated with redeeming the prize. These are the responsibility of the entrant.

  16. On submission of each entry (including the material within the entry – i.e. “Work”) the entrant grants to the Promoter an irrevocable, perpetual, worldwide, royalty free, non-exclusive license in the copyright in the Work to use the Work in any media, including You Tube and other social media for any future promotional, marketing and publicity purpose without any further reference or payment or other compensation to the entrant.  Each entrant warrants to the Promoter that each entry submitted is an original work of the entrant that does not infringe the rights of any third party.  Entrants agree that they are fully responsible for the Work they submit. The Promoter shall not be liable in any way for such Work to the full extent permitted by law. Entrants warrant and agree that: (a) they will not submit any Work that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Work; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Work, to the uses and terms herein; (d) their Work shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, work, defamation, privacy, publicity and the access or use of others' computer or communication systems. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.  Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

  17. Promoter’s decision in relation to all aspects of the Competition is final and binding on all who submit and entry and no correspondence will be entered into.

  18. All 'winners' will be mailed 1 prize directly to the address provided in their entry form at the end of each promotion period in the week commencing 26/11/12.

  19. In the event that a prize or part of a prize is unavailable despite the Promoter’s reasonable endeavours to procure the prize, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

  20. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

  21. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The collection, use and disclosure of personal information provided in connection with the Competition is governed by the Promoter’s Privacy Notice available at Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

  22. The Promoter reserves the right to refuse to allow any entrant or person associated with an entrant to take part in any or all aspects of the prize presentation (if this occurs), if the Promoter determines, in its absolute discretion, that any such person is not mentally or physically able to participate safely or on a reasonable basis.

  23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  24. Except for any liability that cannot be excluded by law, the Promoter (for itself and on behalf of its affiliates and the officers, employees and agents of all of the foregoing (each a “Covered Party”) excludes all liability, for any personal injury; or any loss or damage (including loss of opportunity); howsoever caused (including as a result of negligence of any Covered Party) whether direct, indirect, special or consequential, arising in any way out of or in connection with the Competition, including, but not limited to, any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the control of a Covered Party); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by a Covered Party) due to any reason beyond the reasonable control of a Covered Party; (d) any variation in prize value to that stated in the Conditions of Entry; (e) any tax liability incurred by a winner or entrant (f) redemption of the prize and/or (g) participation in this Competition.

  25. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for the consequences of any information supplied by an entrant that is incorrect, inaccurate or incomplete or any error in or corruption of that information occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in the Competition.

  26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

  28. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

  29. Facebook is not a sponsor of this Competition and has no responsibility or liability regarding the conduct or administration of this Competition. While the Promoter retains their rights in their branded features associated with this Competition, the functionality of this Competition including, but not limited to any voting module, contest gadget or channel page, remains the intellectual property of Facebook.

  30. The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
