Get Active with Scunci Competition Terms & Conditions

1.    Information on how to enter and prizes form part of these terms and conditions (“Terms and Conditions”). Any entry not complying with these Terms and Conditions will be deemed invalid and rejected. Submission of an entry is deemed acceptance of these Terms and Conditions.
2.    Entry is open only to residents of Australia aged 13 years or older (excluding Competition Club members). Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this competition.  Employees (and their immediate families) of the Promoter and agencies associated with this competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3.    The competition commences on 10/9/2014 and entries close at 11.59am AEST on 22/10/14 (“Competition Period”).
4.    There are two (2) tiers of this competition, a game of skill tier (“Tier 1”) and a game of skill tier (“Tier 2”).
HOW TO ENTER TIER 1 AND TIER 2:
5.    To enter Tier 1 and be eligible to enter Tier 2, individuals must complete the following steps during the Competition Period:
(a)    Log-on to their own Facebook account;
(b)    visit the Scunci Australia Facebook Page at https://www.facebook.com/Scunci.Australia (“Facebook Page”);
(c)    follow the prompts to the ‘Scunci Get Active’ promotional application;
(d)    click the ‘allow’ button as prompted, to permit the Promoter access to their basic information;
(e)    input the requested details as prompted; and
(f)    submit the fully completed entry form.
6.    To be eligible to enter Tier 2, valid Tier 1 entrants must invite friends by following the prompts on the Facebook Page during the Competition Period. For every invited friend that enters the promotion by following the instructions provided, the entrant who invited them will receive one (1) point. Tier 1 entrants warrant that each individual that they do invite is an Australian resident aged 13 years or over.
7.    Multiple entries are permitted in Tier 1 subject to each entry being submitted separately and in accordance with entry requirements. Only one (1) point permitted per eligible invited friend/relative in Tier 2.
TIER 1:
8.    The Tier 1 Competition is a game of skill. Chance plays no part in determining who is selected as a winner. Winners are determined by the best answers as determined by the judges and judging will take place at the Promoter’s premises.There will be five (5) weeks of prizes being awarded for Tier 1. Entries will open at 12:00am AEST on each Wednesday of the Competition Period and close at 11:59am AEST on each Wednesday of the Competition Period. Winners names will be published in the ‘competitions’ section on www.scunci.com.au within seven (7) days of the winners being chosen, and will remain on the website for a period of at least twenty-eight (28) days.
9.    The best answers each week will each win the prize that corresponds to that week as outlined in the prize table below.
10.    The Tier 1 total prize pool value is AU$3,333.75

TIER 2:
12.    Tier 2 is a game of skill and chance plays no part in determining the winners. There will be three (3) rounds conducted for Tier 2 (each a “Round”). Entries in each Round will open at 12:00am AEST and close at 11:59pm AEST on the dates outlined in the table below.

13.    Tier 2 entrants will be awarded one (1) point for each eligible invited friend who subsequently enters the promotion by following the instructions provided, in accordance with clause 6 above. The valid Tier 2 entrant who has accumulated the most points up until the closing date for that particular Round (and has not already won a Tier 2 prize), will be deemed the winner for that Round and will win the prize that corresponds to that Round, as outlined in the prize table below.
14.    In the case of a tie between one (1) or more entrants in a particular Round, the tied entrants will be required to submit a twenty-five (25) word or less answer to the following question “What is your favourite Scunci product and why?” Each tied entry will be individually judged based on literary and creative merit of the answer provided to the promotional question. The best valid tied entry, as determined by the Promoter, will be deemed the winner for that Round.
15.    Tier 2 Round winners names will be published under the ‘competitions’ tab on www.scunci.com.au within seven (7) days of being chosen and will remain on the website for a period of at least twenty-eight (28) days.
16.    Only one (1) Tier 2 prize is permitted per person.
17.    The Tier 2 total prize pool value is AU$1,697.75.

GENERAL:
18.    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
19.    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
20.    Incomplete or indecipherable entries will be deemed invalid.
21.    The Promoter’s decision in relation to all aspects of the competition is final and binding and no correspondence will be entered into.
22.    Any ancillary costs associated with redeeming any voucher are not included. Any unused balance of any voucher will not be awarded as cash. Redemption of the any voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
23.    If for any reason a winner does not take a prize (or an element of the prize), then the prize (or that element of the prize) will be forfeited.
24.    In the event that a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
25.    Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
26.    The Promoter collects personal information ("PI") in order to conduct the competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Notice, which can be viewed at http://www.scunci.com.au/legals.aspx.  In addition to any use that may be outlined in the Promoter’s Privacy Notice, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Notice also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
27.    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
28.    Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its respective affiliates and the officers, employees and agents of all of the foregoing (each a “Covered Party”)) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the control of a Covered Party); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by a Covered Party) due to any reason beyond the reasonable control of a Covered Party; (d) any variation in prize value to that stated in the Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) any tax liability incurred by a winner or entrant; and (g) use of and/or redemption of the prize.
29.    Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
30.    If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
31.    Any cost associated with accessing the competition website is the entrant’s responsibility and is dependent on the Internet service provider used.
32.    Entry and continued participation in the competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
33.    The laws of Australia apply to this competition to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
